| 1. | Tour Fares: The tour fares quoted on this website are in Australian Dollars (A$) and include Australian Goods and Services Tax (GST). Fares quoted are valid until 31st March 2011 Fares for extended tours (1 or more nights) that include accommodation of whatever nature are per person on a twin share basis. Single supplements are applicable for single travellers requesting single accommodation. Forced singles are also required to pay the single supplement. |
| 2. | Bookings & Deposits: To confirm a tour booking, a deposit or full payment must be paid at the time of making your reservation by credit card or by direct bank deposit. Balance of the tour fare is to be paid 7 days prior to the date of departure. Reservations made within 7 days of departure date will require payment in full. |
| 3. | Passenger Cancellations: Cancellation must be received in writing and fees will be levied relative to the amount of notice given. Transferring to another departure date may be treated as a cancellation if insufficient notice is given and the tour positions cannot be filled by other passengers before departure. The following cancellation fees apply - Less than 48 hours - 100% 48 hours to 7days - 50% More than 7 Days - 10% |
| 4. | Tour Itinerary: Passengers accept that bigNT may need to alter or amend itineraries, accommodation or sightseeing arrangements from those published, with little or no notice. This may be due to road conditions, weather, safety factors and other operational considerations at the time. Such decisions will be made in the best interests of the passenger's comfort and safety. bigNT is unable to guarantee exact arrival or departure times and is not liable for any failure to make connections with any other service or guarantee the operation of any particular service. Passengers are advised that bigNT tours include services provided by Third party operators such as accommodation, attractions and cruises. bigNT will not be liable for any loss, damage, omission or act of negligence or otherwise committed by these operators, their assignees or agents. |
| 5. | Tour Involvement: Smoking is not permitted on board bigNT vehicles as per government regulation. Passengers accept that tours include participation in activities which may involve certain risks and dangers beyond the control of bigNT. Such activities containing risks include but are not limited to, walking, swimming, and travelling in remote locations. Passengers accept that some itineraries include visits to and overnight stays in areas located some distance from hospitals, medical centres or other forms of professional medical facilities. Passengers accept that it is their responsibility to ensure that their health is in a state which will allow them to enjoy the tour and successfully complete the activities that the tour offers. Passengers will not be permitted to continue on tours when in the opinion of the bigNT driver/guide, the passenger's conduct is placing their own or the safety of other passengers at risk, or is adversely affecting the enjoyment of other passengers; for whatever cause. bigNT will take all reasonable steps to provide an enjoyable tour. However, no liability will be accepted for any loss of enjoyment experienced by passengers due to circumstances which are out of our control. Passengers are asked to notify bigNT of any special health or dietary requirements at the time of booking. bigNT will make every effort to accommodate these requests but cannot guarantee that the special requirements will be met in all instances. |
| 6. | Travel Insurance: bigNT strongly advises passengers to take out travel insurance to cover any unforeseen circumstances, such as cancellation. |
| 7. | Dispute Resolution: Should any dispute arise between bigNT and a passenger, it is agreed that before any formal proceedings in a Court or Tribunal commence, bigNT's documented Dispute Resolution Process will be complied with. Formal proceedings may be commenced if there is no resolution to the dispute at the expiration of 30 days from the commencement of the resolution process. Northern Territory Law applies to these Terms and Conditions and the parties submit to the jurisdiction of the Courts and/or Tribunals of the Northern Territory to determine any disputes between the parties. |
